JUSTICE MIHIR KUMAR JHA ORAL ORDER 02-02-2015 After some argument learned counsel for the petitioner in respect of the prayer made in this writ application reading as follows:
"This is an application for issuance of appropriate order/orders, writ or direction on the respondents to pay Terminal benefits and all other lawful dues to the petitioner as per the following direction/ observation made in C.W.J.C.No. 2329 of 2002 and C.W.J.C.No. 14202 of 2001 disposed of by order dated 6.8.2002 by Mr. Justice Aftab Alam against the Award passed in Reference No.5/96.
"It is therefore, directed that payment of arrears of salary, terminal benefits and all other lawful dues shall be made to the concern workman, as and when the payments would fall due in terms of the direction of the Supreme Court, treating him as having been promoted to the post of ATI with effect from the date on which the last person was
Patna High Court CWJC No.413 of 2015 (2) dt.02-02-2015 promoted to the post on the basis of the empanelment notice dated 219.4.1988."
seeks permission to withdraw this application with an undertaking that the petitioner shall not move this Court again for the same cause of action.
This application is, accordingly, permitted to be withdrawn subject to the aforementioned undertaking.
