The petitioner is languishing in custody since 15.03.2012 in connection with Sessions Trial No. 311 of 2012, arising out of Riga P.S. Case No. 33 of 2012 for the offences instituted under Sections 302/34 of the IPC.

The prosecution story, in brief, is that on 12.03.2012 the petitioner who happens to be the husband of the victim and her Dewar assaulted the victim with intention to kill her as a result of which she died.

The earlier bail application of the petitioner was rejected vide Annexures-1 and 1/1 to the present application. This is third

Patna High Court Cr.Misc. No.52115 of 2015 (5) dt.06-09-2016 2/2 attempt on behalf of the petitioner for grant of bail. A report was called for from the court below regarding the stage of the case. The same is at Flag-'A'. It has been reported that the trial is at the stage of defence evidence and it is expected that the trial will be concluded within a period of three months. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner at this stage. The same is rejected in Sessions Trial No. 311 of 2012, arising out of Riga P.S. Case No. 33 of 2012, pending in the court of the learned Additional District Judge-1st, Sitamarhi. The court below is directed to take all necessary steps to conclude the trial preferably within a period of four months from the date of receipt/production of copy of the order.
