JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Unknown thieves committed theft in the shop of informant whereunder taken away electronic items (mobile set) etc. as well as in the wine shop. During course of investigation, IMEI Number of stolen mobile set were traced out and then, details were obtained, individuals were identified, who had disclosed that petitioner is the person, who had sold the aforesaid mobile set and produced the same as per Para-42. Then thereafter, petitioner was apprehended, who also produced one of the stolen mobile set. Subsequently thereof, on the confessional statement of petitioner, police had recovered stolen mobile set from different persons, who have had consistently stated that they have purchased the respective mobile set from the petitioner. For the present, I do not see it a fit case for grant of bail. Accordingly, payer of petitioner for bail is rejected. However, petitioner will be at liberty to renew his prayer for bail after examination of informant.
