JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-04-2023 Though the present writ petition has been filed for restraining the respondent- authorities from dispossessing the petitioners from the land situated at Mauza- Andoli Thana no. 61, Khata no. 307, Khesra no. 708, Kishanpur, Supaul, however, it is the stand of the respondents, as is apparent from the counter affidavit filed in the present case, that the encroachment over the land in question has already been removed after legally initiating encroachment proceedings vide encroachment case no. 2 of 2016-17 and taking recourse to the due process of law. Having regard to the facts and circumstances of the case, nothing survives for consideration in the present petition,
