The petitioner is apprehending his arrest in a case registered under Sections 461/379 of the Indian Penal Code. The prosecution case, in short, is that the accused persons committed theft in the shop of the informant. People caught hold of accused Md Sarif who took the name of the petitioner and one Sanjiv Kuamr as his associates. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no recovery of incriminating material from the conscious possession of the petitioner.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below it within a period of six weeks
Patna High Court CR. MISC. No.21925 of 2019(3) dt.08-07-2019 2/2 from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Runnisaidpur Police Station Case No. 124 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
