Petitioner is named in the first information report and it is alleged that the petitioner and some other accused chased the deceased but allegedly, it were Vijay Yadav, Janki Yadav, Sri Yadav, Ramchandra Yadav and Indradev Yadav who shot fire on the deceased. The alleged occurrence took place in the year 2008 and the petitioner could be remanded in this case on 14.9.2015. The submission on behalf of the petitioner is that the petitioner had gone outside the State in connection with his livelihood and, as a matter of fact, one Chotu Yadav was murdered for which Bodh Gaya P.S. Case no. 53/2008 was registered and in the aforesaid case, petitioner was witness and that is the reason of his false implication in the present case. It is further contended by him that, however, having more or less similar allegation some co-accused

Patna High Court Cr.Misc. No.53254 of 2015 (2) dt.26-11-2015 have already been granted privilege of bail by a coordinate bench of this court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Bodh Gaya P.S.
