The petitioner has prayed for regular bail in a case registered for the offence punishable u/s 30(a), 38(1), 41(1) of Bihar Prohibition and Excise Act & section 414/34 of IPC. Prosecution case relates to recovery of a huge quantity of illicit liquor about 10037 liters from three different vehicles. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. Petitioner has no concern with the alleged recovery of illicit liquor or with the vehicles in question rather his name has been transpired in this case on the basis of disclosure made by apprehended co-accused namely, Gaurav Bhatti. Moreover, similarly situated several co-accused persons have already been granted bail by different co-ordinate Bench of this Court and in support of this Annexure-2 series has been annexed with this petition. Moreover, the petitioner is languishing in judicial custody since 16.12.2022.

Learned APP appearing for the State has vehemently opposed the prayer of Bail and submitted that the petitioner has got several criminal antecedents.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kudhani (Turki O.P) P.S. Case No. 47 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No.2, Muzaffarpur.
