JUSTICE SHIVAJI PANDEY ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Mokama P.S.Case No. 165 of 2014 registered u/s 399, 402, 414 IPC and 25(1-B)a, 26/35 of Arms Act.

The Police conducted a raid and arrested the petitioner along with other accused persons.

Allegation has been made of committing crime. From the conscious possession of the petitioner, a country-made loaded pistol was recovered. Petitioner he also accused in a case of similar nature, as mentioned in Para-3 of the petition. He is in custody since 21st August 2014.

In the facts and circumstances of the case, petitioner Sandhir Kumar @ Samir Kumar @ Sudhir Kumar @ Sadhir is

No.51333 of 2014 (2) dt.03-03-2015 2/2 directed to be released on bail on or after 6th April 2015 on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ashutosh Kumar, J.M. 1st Class, Barh in connection with Mokama P.S.Case No. 165 of 2014, with the conditions that : (i) one of the bailors will be a close relative of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds and (iii) the petitioner would co-operate in the proceeding and if the petitioner would fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court below will pass appropriate order, including cancellation of bail bonds.
