The petitioner seeks regular bail in connection with Khaira P.S. Case No. 372 of 2018 registered for the offence punishable under Sections 272, 273 and 120(B)/34 of the Indian Penal Code and Sections 30A and 38(1) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 155 litres of illicit liquor from an auto rickshaw.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as neither any recovery has been made from the conscious possession of the petitioner nor the auto rickshaw

Patna High Court Cr.Misc. No.8979 of 2019(2) dt.15-02-2019 2/2 belongs to the petitioner. It is submitted that though the petitioner is an accused in one other case but he is on bail in the said case. Lastly, it is submitted that the petitioner is languishing in custody since 30.12.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-2nd, Jamui in connection with Khaira P.S. Case No. 372 of 2018.
