====================================================== CORAM: HONOURABLE MR. JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 09-02-2022 Heard the parties through video conferencing. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 05 of 2020 registered for the offence under Sections 498(A), 494 of the Indian Penal Code and Section 3⁄4 of the D.P. Act.

Learned counsel for the petitioner submits that the wife of the petitioner had left the matrimonial home itself and he has filed a case under Section 9 of the Hindu Marriage Act for restitution of conjugal rights in 2018, whereafter she has lodged the present F.I.R. that she was ousted from matrimonial home in 2019, whereas she has been staying in her own house since 2017 and the story is false.

No.20524 of 2021(3) dt.09-02-2022 2/2 Taking into consideration the contents of the F.I.R., I am inclined to grant benefit of anticipatory bail to the above named petitioner and in the event of arrest he shall be released on bail, subject to the conditions as laid down under Section 438

(2) of the Cr.P.C.
