2. The petitioners are apprehending their arrest in connection with Chakai P.S. Case No. 239/2022 dated 29.09.2022 registered for the offences punishable u/ss 379, 411 and 414 of the Indian Penal Code.

3. As per the prosecution case, the petitioners and the co-accused person are loading electric goods including cable, pole, cross, clam-pin, disc, earthing wire etc on the DCM truck. On being objected by the informant, the petitioners along with 8-10 unknown miscreants came and threatened to kill, in the meantime, police was informant and all the accused persons fled

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have no criminal antecedent as stated in para 3 of the bail petition. There is a delay of 41 days in lodging the FIR. Nothing has been recovered from the conscious possession of the petitioners.

5. Learned A.P.P. for the State has vehemently opposed the prayer of anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Jamui in connection with Chakai P.S. Case No. 239/2022, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

7. This application stands allowed.
