1. Heard Mr. Baidyanath Prasad learned counsel for the petitioner and Mr. Kalyan Shankar, learned APP for the State.

2. The petitioner seeks regular bail in connection with Sadar (Sonki OP) P.S. Case No. 763 of 2023 dated 01.11.2023 registered for the offence punishable under Section 306/34 of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to the suicidal death of the informant's daughter and the accused persons named in the FIR were alleged to have abated the victim to commit suicide by making an allegation of her involvement in immoral activities but the said allegation is not against the petitioner and

No.9045 of 2025(3) dt.09-05-2025 2/3 he is not named in the FIR and during the course of investigation, the petitioner was made accused mainly on the basis of the allegation that he had sent the obscene photograph of the victim to her family members using his mobile phone, but, in this regard there is no electronic evidence and even victim's close family members did not support the said allegation during investigation and subsequently the informant entered into a compromise with this petitioner upon realizing that the petitioner had no role in the alleged crime of suicide. It is lastly submitted that the petitioner has been languishing in jail since 25.11.2024 having fair and clean antecedent and against him the investigation has been completed.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.

5. Considering the facts and circumstances of this case as well as the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's young age, his fair and clean antecedent and also coupled with the completion of investigation against him, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail in connection with Sadar (Sonki OP) P.S. Case No. 763 of 2023 on furnishing bail bond of
