JUSTICE RAJEEV RANJAN PRASAD) Date: 17-04-2018 Challenging the judgment dated 06.09.2017 passed in C.W.J.C. No. 16505 of 2014, the writ petitioners have preferred this intra-court appeal.
2. It appears that the petitioners had preferred the Writ Application for a declaration to the respondents to regularize them in service as Sepoy Driver. They also prayed for declaration from this court that for purpose of their regularization or for fresh appointment a higher educational qualification which has been provided by
notification contained in Memo No. 233 dated 21.04.2014 would not apply as according to them the educational qualification of Intermediate as has been provided by the said notification cannot be given retrospective effect.

It was the case of the writ petitioners that pursuant the Advertisement bearing No. 01/2010, as contained in Annexure 2 to the writ application, they participated in the selection process undergoing the physical test and other test which were required and since their appointment they are working as Sepoy Driver in the Police Department. After they were appointed, the Notification dated 03.03.2014 was issued whereunder a higher qualification of Intermediate pass has been provided for appointment on regular basis of a Sepoy Driver in the Police Department. The petitioners are matriculates only and, therefore, it is their contention that such higher qualification would be an impediment in their way for appointment.

The case of the petitioners was contested by the respondents no. 2 and 6 who submitted that in the year 2010 there were vacancies of 610 Driver Constables in the Police Organization and because of the delay taking place in the recruitment of Driver Constable a permission was granted by the Home Department to appoint Driver Constable on contractual basis. Referring to the Advertisement (Annexure 2 to the writ application) it was submitted
that from the terms and conditions mentioned in the Advertisement dated 20.08.2010 it would appear that the candidates were fully aware of the fact that contract appointment will be only for 11 months and it will be provided on signing of agreement. It was also provided that the contract appointees shall not be treated as government servants.
5. The learned Writ Court having considered the submissions advanced on behalf of the parties and upon taking into consideration the judgment of Hon'ble Supreme Court in the case of Y.V. Rangaiah and others v. J. Sreenivasa Rao and others, reported in AIR 1983 SC 852, as also in the case of Union of India & Ors. Vrs. N.R. Parmar & Ors., reported in (2012) XII S.C.C. 320, held that the minimum educational qualification of Intermediate for appointment on the post of Sepoy Driver was brought about in the year 2014 whereas the Advertisement for appointment on permanent basis has been issued in the year 2016, therefore, it cannot be said that it is a case of alteration with regard to the educational qualification after issuance of Advertisement. The eligibility condition was brought in effect well before issuance of Advertisement and therefore, it is not a case of giving retrospective to an amendment.
6. The learned Writ Court dismissed the writ application considering the grounds taken upon by the petitioners, however while dismissing the writ application the learned Writ Court observed that if
the petitioners, so desire, may file representations before the Department to consider their case for regularization in accordance with law.
7. This Letters Patent Appeal has been heard together with C.W.J.C. No. 4972 of 2018 which was preferred by some of the similarly situated Sepoy Constables challenging Rules 9 and 10 of the Bihar Police Driver Cadre Rules, 2017. The submissions advanced by the appellants in the present case are the same rather identical to that of the writ petitioners; we have already dealt with all the issues raised therein in detail which may be found in the order passed in C.W.J.C. No. 4972 of 2018. So far as the present appeal is concerned we find that the learned Writ Court has rightly considered the submission advanced on behalf of the writ petitioners-appellants and came to a conclusion that an amendment brought in the Bihar Police Manual had come into effect well before issuance of Advertisement bearing Memo No. 01/2016, therefore, no challenge can be made to the Advertisement on that ground.

So far as the claim of the petitioners for their regularization is concerned, the learned Writ Court has already provided in the impugned judgment itself that the petitioners, if so desire, may file their representations before the Department to consider their case for reguralization in accordance with law.
9. We don't find any reason to interefer with the impugned judgment of the learned Writ Court. However we make it clear that since the learned Writ Court has left it for the writ petitioners to represent their case before the respondents for regularization, that aspect of the matter is left open for consideration by the State respondents in accordance with law. We have not gone into that aspect of the matter at this stage.
