JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2021 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with Cheriyabariyarpur (Manjhaul) P. S. Case No.93 of 2020 registered for the offences punishable under Section 392 of the I.P.C.
Learned counsel for the petitioner submits that from bare perusal of the allegations as alleged in the F.I.R., it would manifest that the informant, who is the Branch Manager of a private financial company namely, Fusion Micro Finance Company Private Limited, Majhaul, Begusarai has alleged that on 10.06.2020 while he was returning along with his staff namely, Sumit Kumar after collecting money from its customers
Patna High Court CR. MISC. No.19669 of 2021(2) dt.15-11-2021 2/3 and when he reached near Harsain Bridge then four criminal on a motorcycle intercepted them. They looted Rs.72,000/- of collection and their two mobile phones at gun point and ran away.
Learned counsel for the petitioner submits that the petitioner is a student and his education qualification has been given in Para-11 and 12 of the bail petition. The F.I.R. is against unknown and the name of this petitioner is alleged to have transpired based on the secret information received by the police spy. Petitioner is in custody since 21.09.2020 and the chargesheet has been submitted. Learned counsel for the petitioner submits that the occurrence is alleged to have taken place on 10.06.2020, in which money and mobile of informant was looted, but the F.I.R. was instituted on 11.06.2020 i.e. after a delay of 20-21 hours and the same has not been properly explained in the F.I.R. Considering the fact that petitioner is a student and is in custody since 21.09.2020, charge-sheet has been submitted, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Manjhaul, Begusarai in connection with Cheriyabariyarpur
