JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bangaon P.S. Case No. 118 of 2018 registered for the offences punishable under Sections 30(a), 38(1) and 41(1) of the Bihar Prohibition and Excise Act. Allegation is of recovery of 1702 litres of liquor and petitioner is accused in five other cases of similar nature. Submission of learned counsel for the petitioner is that recovery has not been made from the possession of the petitioner, rather from the co-accused and so far other cases are concerned, he is on bail in those cases.

Heard learned APP also.

Having heard both sides and in view of allegation and criminal antecedents of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should

Patna High Court Cr.Misc. No.9689 of 2019(2) dt.19-02-2019 2/2 surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
