JUSTICE JYOTI SARAN ORAL ORDER 15-11-2017 Heard Mr. Prashant Sinha, learned counsel appearing for the petitioner and Mr. Rakesh Ambastha, learned Assisting Counsel to Additional Advocate General No.7.

The writ petition was disposed of without interfering with the removal order of the petitioner but with liberty to respond if any vacancy is advertised by the Nagar Parishad. Mr. Sinha, learned counsel appearing for the petitioner complains contempt against the Nagar Parishad for according to Mr. Sinha, the Nagar Parishad instead of advertising vacancy is filling the post through other method. In my opinion, even if the statement of the petitioner is accepted on its face value yet no contempt is made out for the

Patna High Court MJC No.1680 of 2017 (2) dt.15-11-2017 complaint of such kind may have to be raised in an appropriate proceeding before appropriate forum but certainly not in contempt jurisdiction.

The contempt application is dismissed.
