The petitioner is accused in connection with Fulkaha P.S. Case No. 10 of 2013, registered under Section 392 of the Indian Penal Code.

The accusation is that on 18.04.2013 informant was returning back to his home along with his associates from Bhimnagar by Scorpio bearing registration No. BR-11H-282. In the way, some unknown miscreants stopped the vehicle by keeping bolder. Thereater, 4-5 miscreants looted the informant and his associate. The miscreants also looted informant's licensee loaded revolver along with eight live cartridges. Learned counsel for the petitioner submits that it appears from the F.I.R. that petitioner is not named in the F.I.R.

Patna High Court Cr.Misc. No.51404 of 2015 (2) dt.22-12-2015 2/2 rather in course of investigation the name of the petitioner has come in the confessional statement of co-accused, Mahesh Yadav showing the involvement of the petitioner in the present case except that there is nothing against the petitioner. It is further submitted that co-accused Mahesh Yadav, has already been allowed bail by a Bench of this court vide order dated 01.12.2015 passed in Cr. Miscellaneous No. 54039 of 2015. It is further submitted that petitioner is in custody since 08.06.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.V.D. Dubey, Judicial Magistrate 1st Class, Araria in connection with Fulkaha P.S. Case No. 10 of 2013.
