The petitioner seeks bail in connection with Rampur P.S. Case No.169 of 2015 registered under Sections 25(1-B)a, 26 and 35 of the Arms Act.
The accusation is recovery of one country made loaded pistol alongwith three live cartridges from the possession of the petitioner.
Learned counsel appearing on behalf of the petitioner submits that there was no criminal antecedent against the petitioner but after his arrest in this case, the petitioner has been remanded in Fatehpur P.S. Case No.229 of 2015 falsely showing
Patna High Court Cr.Misc. No.51057 of 2015 (4) dt.08-02-2016 2/2 the recovery of arms from another place. Except that, there is nothing against the petitioner who is in custody since 10.07.2015 in the present case.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Gaya, in connection with Rampur P.S. Case No.169 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
