JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-04-2019 This is an application for grant of anticipatory bail in connection with Nawada Muffasil P.S. Case No. 166 of 2018, disclosing offences under Sections 448, 341, 323, 354B, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioners is that they have entered inside the house of the informant armed with pistol, thrashed her on the ground and torn her cloth and when her sister Asma Khatoon came to save her, she was assaulted by butt portion of the pistol and they also snatched away golden chain and as the villagers assembled, their modesty were saved. No.9509 of 2019(3) dt.24-04-2019 2/2 that prior to that a case has been lodged by the daughter of the petitioner no.3 against the brother of the informant under Section 498(A) of the Indian Penal Code and for that the present false case has been lodged against the petitioners. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Nawada, in connection with Nawada Muffasil P.S. Case No. 166 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
