The petitioner, Prakash Verma @ Jaiprakash Verma, seeks regular bail in Khudwan P.S. Case No.34 of 2013, registered under Section 435 and other sections of the Indian Penal Code, under Section 27 of the Arms Act and under Section 17 of the C.L.A. Act.
Shaukat Ali, the informant, Driver of J.C.B.
machine, lodged the case against unknown and alleged that many Maoists had come with arms and ammunitions, set ablaze the J.C.B. machine and fled away shouting slogans. Petitioner is not named in the first information report. The name of the petitioner figured in the case in the confessional statement of co-accused Kapil Yadav and Surendra Mehta.
Patna High Court Cr.Misc. No.407 of 2015 (2) dt.08-01-2015 2/2 It is submitted that the other accused persons have been granted bail.
Considering the facts aforesaid, the prayer for bail is allowed.
The petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Khudwan P.S. Case No.34 of 2013.
