A passenger who was travelling in a train been victimized whereunder his belongings were taken away stealthily by the unknown thieves and for that, instant case has been registered against unknown. During course of investigation petitioner was remanded in this case after having been apprehended in connection with other cases and in the aforesaid background as is evident from para-3 of the petition, petitioner has got criminal antecedent. So far present case is concerned, certainly there happens to be no evidence.

As such, petitioner Pankaj Singh is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the

Patna High Court Cr.Misc. No.53866 of 2015 (3) dt.30-01-2016 satisfaction of learned Railway Judicial Magistrate, Kiul, Lakhisarai in connection with Jhajha G.R.P.P.S. Case no.44 of 2015. However, considering the criminal antecedent of the petitioner, it looks desirable to clinch with a condition and for that it is ordered that one of the bailor should be a government servant whose identity, the learned lower court will ascertain, before acceptance of bail bond.
