JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Though this Court has roaster of anticipatory bail but the present application being regular bail application has been notified before this Court under the orders of Hon'ble the Acting Chief Justice as the mother of the petitioner has died, though, no affidavit to that effect has been filed. Let the office paste the notification on one of the pages of the ordersheet. The petitioner is languishing in jail since 12.10.2015 in a case registered for the offences punishable under Sections 341, 323 and 307/34 of the Indian Penal Code.

The prosecution case is that the petitioner and coaccused Ramautar Manjhi assaulted the mother of the informant and when the informant and his brother went to rescue then they were also assaulted by the accused persons. It is specifically alleged against this petitioner that he assaulted with iron rod on the

It is submitted by learned counsel for the petitioner that the medical report of the brother of the informant, brought on record, as annexure-2, suggests simple injury caused by hard and blunt substance. It is further submitted that the injury report of the informant and mother of the informant are not on record. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM, 1st Class, Nalanda at Biharsharif in connection with Giriyak P.S.
