====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-02-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 379, 384, 504, 506/34 of the Indian Penal Code.
3. Prosecution case, in brief, is that on the alleged date and time of occurrence, all the F.I.R. name accused persons including these petitioners came at the shop of the informant and demanded ransom of Rs.15 lacs. Later on, in the evening, the accused persons forcibly closed the shop of informant and took him in a room near Manpur Shiv Mandir and assaulted him
Patna High Court CR. MISC. No.10054 of 2025(2) dt.20-02-2025 2/3 with iron rod and when informant tried to escape, co-accused Sanjay Singh @ Bablu Singh assaulted and fired upon him causing injury. It is further alleged that the accused persons also snatched mobile phone, cash and gold chain of the informant.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. He further submits that specific accusation of firing and causing injury is against co-accused Sanjay Singh @ Bablu Singh. Allegation against petitioners is general and omnibus and there is no allegation of specific overt act against these petitioners. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Mufassil P. S. Case No. 1122 of 2022, subject to condition as laid down under Section 438(2) of the
Patna High Court CR. MISC. No.10054 of 2025(2) dt.20-02-2025 3/3 Code of Criminal Procedure.
