JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-03-2023 The present writ petition has been filed seeking the following relief:- "1(i) To issue appropriate writ/ order in nature of Writ of Mandamus directing Respondents particularly, Respondent No.
4 to henceforth initiate an effectual inquiry into the Respondents' failure to provide adequate and quality care & treatment to the Petitioner, an HIV +ve woman at the Nalanda Medical College Hospital (N.M.C.H.).
(ii)To issue appropriate writ/ order in
Patna High Court CWJC No.18597 of 2015(2) dt.24-03-2023 2/2 nature of Writ of Mandamus directing Respondents particularly, Respondent Nos. 2, 4 & 5 to take appropriate departmental action against the erring doctors & staffs of the N.M.C.H. who maintained untouchability and inflicted cruel, inhuman & degrading behavior against the petitioner in refusing to conduct her delivery."
Considering the allegations and counter allegations, as also the fact that the present writ petition has lost its efficacy with the efflux of time, the learned counsel for the petitioner does not deem it fit and proper to press the present writ petition, however, seeks an observation qua the respondent-authorities to be more cautious and vigilant in future, while tackling the patients infected with H.I.V positive virus. It is directed accordingly.
The writ petition stands disposed off.
