JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-02-2020 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Rajnagar P.S. Case No. 325 of 2019, registered under Section 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant, aged about 13 years, by the petitioner with the help of his family members for the purpose to perform the marriage. Learned counsel for the petitioner submits that, in fact, due to love affairs daughter of the informant left her parental house with the petitioner according to her own sweet will, which would appear from her statement recorded under Section 164 Cr.P.C., wherein her age was assessed as 16 years.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani, in connection with Rajnagar P.S.
