JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 The petitioner seeks regular bail in connection with Bochaha P.S. Case No. 404 of 2019, registered for offences punishable under Sections 147, 148, 341, 323, 324, 379, 427 and 307 of the Indian Penal Code.

As per F.I.R. it is alleged that petitioner and other accused persons assaulted the Barat party, who had come in connection with marriage of daughter of informant and in the said occurrence persons, namely, Ranjan Kumar, Suresh Chaudhary, Mohit received fracture injuries. It is also alleged that accused persons took away the gold ornaments worth Rs. Two Lakhs.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he has been in judicial custody since 10.12.2019

Patna High Court CR. MISC. No.7679 of 2020(2) dt.18-02-2020 2/2 Learned counsel appearing on behalf of the State opposed the prayer for bail on the ground that petitioner is accused in one more case and there is allegation against this petitioner also of assault and vandalism.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XIV, Muzaffarpur in connection with Bochaha P.S. Case No. 404 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
