The petitioner apprehends his arrest in Majorganj P.S. Case No.189 of 2020 (wrongly mentioned as Sitamarhi P.S. Case No.189 of 2020 in the prayer portion of the bail petition), registered for the offences punishable under Sections 341, 323, 308, 379, 504 and 34 of the Indian Penal Code. The petitioner and other co-accused persons are said to have assaulted the informant and her mother-in-law. The petitioner assaulted the mother-in-law of the informant by means of iron rod on her head. Other accused persons assaulted the family members of the informant by means of bamboo stick. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.9544 of 2022(2) dt.02-08-2022 2/2 present case. It is further submitted that the occurrence took place on 05.11.2020, but the FIR was lodged on 01.12.2020 after delay of about 25 days. It is lastly submitted that the petitioner has got no criminal antecedent.

The learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that FIR was lodged after delay of about 25 days, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Majorganj P.S. Case No.189 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
