The petitioner seeks bail in connection with Rajoun P.S. Case No. 433 of 2021 instituted for the offences under Section 420 of the Indian Penal Code and Sections 30(a) and 32(2) of the Bihar Prohibition & Excise Act, 2018. Learned counsel for the petitioner submits that the petitioner is in custody since 10.11.2021, is a person of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 4392.56 liters of liquor from a truck. Learned counsel for the petitioner submits that the petitioner is the driver of the truck and as such petitioner was not knowing what was loaded in the truck by the owner and

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 10.11.2021 and charge-sheet has been submitted in the case and petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -II, Banka in connection with Rajoun P.S. Case No. 433 of 2021.
