The petitioner seeks regular bail in a case registered under Section 307 and other sections of the Indian Penal Code. The informant Md. Ahsan named eight persons and alleged that on the order of Md. Wadu, the petitioner Md. Annas assaulted him with sword on his head.
It is submitted that the petitioner is the own brother of the informant. On account of land dispute, the occurrence took place. The informant got one wound on his upper forehead 1" x 1/8". The informant was referred to D.M.C.H. but no X-ray of the injury of the informant was done. The opinion has not been given by the doctor with regard to the nature of injury. The petitioner is in jail since22.11.2014.
It appears that single blow with sword was given to
Patna High Court Cr.Misc. No.85 of 2015 (5) dt.19-03-2015 2/2 the informant causing injury on his forehead 1" x 1/8" and the doctor has not opined about the nature of injury as X-ray was not obtained by the informant. The petitioner and the informant are own brother and the occurrence took place due to land dispute. The petitioner has already remained in jail for about four months. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in Ghanshyampur P.S. Case No. 42 of 2014.
