JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks regular bail in connection with Khaira (Nagra) P.S. Case No. 355 of 2019 registered for the offence punishable under Sections 30/38/41 of the Bihar Prohibition & Excise Act, 2016.
Allegation as per F.I.R. is of recovery of 83.49 liters of illicit liquor from Honda Amaze car and the apprehended accused persons disclosed the name of the petitioner. Submission of the learned counsel for the petitioner is that there is nothing against the petitioner except confessional statement of co-accused. He is in custody for about one month and he is ready to co-operate in the investigation. Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named,
Patna High Court CR. MISC. No.7664 of 2020(2) dt.18-02-2020 2/2 be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions JudgeII-cum-Special Judge Excise, Saran, in connection with Khaira (Nagra) P.S. Case No. 355 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned with further condition that he will co-operate in the investigation and will appear before the court as and when required otherwise his bail bond is cancelled.
