It appears petitioner remained absconding for 4 1⁄2 years as it is said that he had gone outside the State to earn his livelihood. After petitioner returned to the village, he was apprehended on 03.09.2014 and since then he is in jail custody. It is submitted on behalf of the petitioner that besides the present case he is not accused in any other case.

In consideration of the fact that petitioner is not accused in any other case, he is directed to file an affidavit that hereafter he shall not misuse the privilege of bail and appear in the court below on every date fixed until the trial is disposed of and thereafter he be released on bail on furnishing bond of Rs. 5,000/- (Five
