Altogether five persons including the petitioners are named in the first information report and it is alleged that they mercilessly assaulted the deceased. In course of investigation, the informant added the name of two other persons. There is omnibus and general allegation of assault against the petitioners and other accused. Moreover, it is not specific as to whether petitioners were carrying any arm at the time of alleged occurrence or not. The post mortem report of the deceased reveals that three injuries were
Patna High Court Cr.Misc. No.36655 of 2015 (3) dt.03-11-2015 2/2 found on his person and the injury found on abdomen became fatal for him but it is not specific who is author of the aforesaid fatal injury.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ramnagar P.S.
