2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 324(4), 303(2), 317(2), 109 and 132 of the B.N.S..

3. As per prosecution case, while informant, namely Shambhu Kumar, along with armed forces were on patrolling duty and saw one tractor coming with illegal sand and on chase, this petitioner, after unloading the sand, fled away with the tractor.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated int his case merely because he happens to be owner of the tractor in question.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is owner of the tractor in question and is involved in theft of sand and is also alleged to have obstructed the informant and others in performance of their duty and tried to cause harm to police forces. Petitioner has also got one criminal antecedent.

6. Considering the nature of accusation and criminal antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
