The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

17 liters of country-made liquor has been recovered near the tower of Bhatgaon road of Barh and petitioner is alleged to have thrown the bag containing aforesaid liquor after seeing the police.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from an open place and only on suspicion, petitioner has been made accused. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances as

No.9658 of 2022(2) dt.14-07-2022 2/2 well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna / concerned court in connection with Barh P.S. Case No. 447 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
