The petitioner seeks regular bail in connection with Khusrupur P.S. Case No. 297 of 2018 for the offences punishable under Sections 399, 402, 411, 413 and 414 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act.
The allegation is regarding the police having received information that some accused persons have assembled at the place of occurrence and were conspiring to commit some crime, whereafter the police arrived there and after apprehending the accused persons, a search was made. As far as the petitioner is concerned, one knife and one motorcycle were recovered. The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.10001 of 2019(2) dt.21-02-2019 2/2 petitioner has been falsely implicated in the present case and there is no allegation of commission of any crime. As far as the petitioner is concerned, it is further submitted that though the petitioner is accused in three other cases but he is already on bail in those cases. It is submitted that the petitioner is languishing in custody since 22.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VI, Patna City, Patna in connection with Khusrupur P.S. Case No. 297 of 2018.
