JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Punaura P.S. Case No. 47 of 2019 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act. Allegation as per F.I.R. is of recovery of huge quantity of liquor from a Tempo and petitioner succeeded in fleeing away. Apart from that he is an accused of one another case in similar nature.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case, there is source of identification which has been mentioned. He is in custody since 11.12.2019. Charge-sheet has already been submitted, there is no chance of tempering with the evidence.

No.8139 of 2020(2) dt.20-02-2020 2/2 Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.D.J. II-cum-Special Judge, Excise, Sitamarhi, in connection with Punaura P.S. Case No. 47 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
