JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Heard learned counsel for the petitioner and the State. The petitioner being the husband is languishing in custody since 02.05.2015 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A/302 and 34 of the Indian Penal Code.

The prosecution case is of killing the sister of the informant after 15 years of the marriage by causing burn injury for non fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that as per the own admission of the informant in fardbeyan petitioner was not present in the house when the victim committed suicide.

No.55999 of 2015 (3) dt.12-01-2016 2/2 Considering the fact that the victim died unnatural death and after conclusion of investigation chargesheet has been submitted under Section 498A and 302/34 of the Indian Penal Code, this Court is not inclined to grant the privilege of bail to the petitioner at present in connection with Bihpur (Bhawanipur) P.S. Case No. 109 of 2015.

Accordingly, the prayer for bail of the petitioner is rejected.
