The petitioner seeks bail in Bahadurpur P.S. Case No. 430 of 2020, registered for the offence punishable under Sections 307, 323 and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with co-accused persons surrounded the informant and thereafter, it is alleged that this petitioner assaulted with sword on the head of informant. It is alleged that due to land dispute between the parties, the alleged occurrence took place.

It is submitted on behalf of petitioner that there is case and counter case. Both sides sustained injury. Though, as per the FIR, this petitioner is alleged to have assaulted the informant with sword, but the injury sustained by the informant has been

Patna High Court CR. MISC. No.11058 of 2022(2) dt.05-05-2022 2/2 found to be caused by hard and blunt substance. Petitioner is in custody since 05.01.2022.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 430 of 2020.
