JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 21-01-2016 In absence of any statute/regulation by which the Court can command and order grant of grace marks to a student, the Court is not willing to exercise his discretion only for mercy or because the Court is supposed to have certain discretion in such issues raised by the petitioner. Right of the petitioner will flow from regulation governing such award of grace marks in the interest of maintenance of standards of education. Grace marks should not be granted as a matter of rule or even on demand.
Writ is dismissed.
