The petitioner seeks bail in connection with Khagaria Rail P.S.Case No.52 of 2010 registered under Section 394 of the Indian Penal Code as well as Section 27 of the Arms Act. Later on, Section 302 of the Indian Penal Code was added. Regard being had to the statement of the victim recorded in para-65 of the case diary in which he named the petitioner as one of the assailants, I am not inclined to grant him bail for the present.
