JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-07-2024 Earlier, the matter was referred to Mediation Centre vide order dated 08.05.2024, but the dispute between the parties could not be settled through the process of mediation and as such, mediation failed (report at flag 'M').

2. Heard the parties.

3. The petitioner apprehends his arrest in connection with Complaint Case No. 977C of 2021 for the offences punishable under Sections 498A and 34 of the Indian Penal Code.

4. There is allegation against the petitioner of matrimonial cruelty and demand of dowry.

5. It is submitted on behalf of the petitioner that pursuant

Patna High Court CR. MISC. No.14862 of 2024(4) dt.29-07-2024 2/2 to the order dated 26.07.2023 passed by this Hon'ble Court in Cr. Misc. No. 41443 of 2022, the petitioner is paying Rs. 10,000/- (ten thousand) per month as maintenance to opposite party no. 2 and petitioner undertakes to pay the same regularly.

6. Learned counsel appearing on behalf of the Opposite Party No. 2 opposed the prayer for bail.

7. Considering the fact that petitioner is paying Rs. 10,000/- (Rupees Ten Thousand) per month to the opposite party no. 2 and undertakes to pay the same regularly, the prayer for anticipatory bail of petitioner is allowed.

8. Accordingly, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Danapur, Patna in connection with Complaint Case No. 977C of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
