Petitioner No. 2 is apprehending his arrest in connection with Salkhua P.S.Case No. 212/2015 registered for the offences punishable under Sections 302, 120 (B) of I.P.C. and under Section 27 of Arms Act.
Case diary in the present case which was called for has since been received.
Learned counsel for the petitioners submits that the present petitioner, though, named in the F.I.R. but there is no specific allegation and only on account of the general and omnibus
Patna High Court Cr.Misc. No.3243 of 2016 (4) dt.21-04-2016 2/2 allegation, the petitioner is facing prosecution. It is further submitted that no specific role has been assigned to the petitioner Seho Nandan Sah in the F.I.R. and in the case diary, no cogent material is available so as to implicate the petitioner in this case. Considering the aforementioned facts and circumstances of the case and also the fact that the petitioner has no criminal antecedent, let the petitioner No. 2, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Saharsa in connection with Salkhua P.S.Case No. 212/2015, subject to condition as laid down under Section 438( 2) of Cr.P.C.
