JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Kudhani P.S. Case No. 86 of 2013 for the offence under Sections 147, 148, 149, 379, 427, 342 of the Indian Penal Code; Sections 3 and 4 of the Explosive Substances Act and Section 17 of the C.L.A. Act Learned counsel for the petitioner submits that it is alleged that the petitioner along other persons assembled at the brick-kiln and they exploded the bomb. He further submits that the petitioner is not named in the FIR nor any incriminating material is available on record against the petitioner, who is in custody since 13.08.2019.

Considering the fact that the petitioner is not named in the FIR and nothing has been recovered from her possession,

Patna High Court CR. MISC. No.8456 of 2020(2) dt.06-02-2020 2/2 the Court is inclined to grant bail to her. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Muzaffarpur in connection with Kudhani P.S. Case No. 86 of 2013.
