The petitioner seeks regular bail in connection with Gardanibagh PS case no. 458 of 2018 registered for the offence punishable under Section 394 of Indian Penal Code. The allegation is regarding the miscreants having snatched Rs. 65000/- and two mobiles from the informant. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case on account of his name having transpired during the course of confessional statement made by co-accused person. It is further submitted that neither any recovery has been made from the conscious possession of the petitioner nor any test identification parade has been held in order to connect the petitioner with the
Patna High Court Cr.Misc. No.10922 of 2019(2) dt.22-02-2019 2/2 alleged crime. It is further submitted that the petitioner is an accused in six other cases, in which he is on bail and the same has been lodged by the next door neighbour, with whom the petitioner is having animosity. Lastly, it is submitted that the petitioner is languishing in custody since 11.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-cum-Sub Judge-XIV, Patna in connection with Gardanibagh PS case no. 458 of 2018.
