The petitioner seeks regular bail in connection with Excise Case No. 7 of 2021 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that total 324 litres of illicit liquor was recovered from two motorcycles.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and he had no knowledge of the recovery as he was not arrested from the spot.

No.19632 of 2021(2) dt.15-11-2021 2/2 It is further submitted that nothing has been recovered from his conscious possession and he is in custody since 06.01.2021, further charge-sheet has been submitted in this case. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 06.01.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, East Champaran at Motihari in connection with Excise Case No. 7 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C.
