The petitioner has filed the writ application, seeking a direction to the Circle Officer, Bhagwanpur in the district of Begusarai to settle the land appertaining to Khata No. 195, Khesra No.1001 in Mauza Manopur, admeasuring 17 decimal. The petitioner claims that she is in peaceful and continuous possession over the land in question since long.

It transpires from the materials available on

Patna High Court CWJC No.271 of 2018(2) dt.29-03-2019 2/3 record that for the relief, which is being claimed in the present writ application, the petitioner had filed an application under the Bihar Right to Public Grievance Redressal Act, 2015. The said application has been rejected by the Sub-Divisional Public Grievance Redressal Officer, Teghra, Begusarai by an order dated 12.01.2017, which has been brought on record by way of Annexure-2 to this writ application. It has been recorded in the impugned order that the petitioner has a Pucca house over her private land, which is situated adjacent to Gairmazarua Khas land of the State of Bihar. The petitioner wants to get the said Gairmazarua Khas land settled in her favour, though she does not fall in the category of eligible person(s) for such settlement.

Learned counsel, appearing on behalf of the petitioner, does not dispute that there is a Pucca house belonging to the petitioner. The petitioner has preferred an appeal against the order of the Sub-Divisional Public Grievance Redressal Officer, Teghra, which has been dismissed.

Considering the facts and circumstances, as pleaded in the writ application, I do not feel persuaded to

Patna High Court CWJC No.271 of 2018(2) dt.29-03-2019 3/3 entertain the petitioner's prayer in the writ application, in view of the undisputed fact that the petitioner has her own Pucca house.

This writ application is accordingly dismissed as meritless.
