Mr.Bharat Bhushan ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-09-2022 At the outset, counsel for petitioners seeks permission to withdraw the anticipatory bail application with respect to Naresh Prasad petitioner no. 3.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the FIR, petitioner no. 1 is said to have assaulted the informant by butt of pistol and petitioner no. 2 assaulted by spear.

Patna High Court CR. MISC. No.9767 of 2022(7) dt.13-09-2022 2/2 It is submitted that injuries attributed to petitioner nos. 1 and 2 are simple in nature. There is case and counter case. The case filed by the petitioners is earlier in point of time bearing Nardiganj PS Case No. 161 of 2021.

Considering the facts aforesaid, the petitioner nos. 1 and 2 above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Nawada in connection with Nardiganj P.S. Case No. 162 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
