2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 40(1) of the Bihar Mining Act, Section 379/34 of the Indian Penal Code and Sections 33, 41 and 42 of the Indian Forest Act.
3. Allegation against the petitioner is that he permitted the stone crusher machines to be operated from his field.
4. It is submitted on behalf of the petitioner that he is not the owner of the land where unauthorized quarried stones are being crushed into stone chips. The said land belongs to Chandradev and Ramraj and as such, petitioner cannot be held
Patna High Court CR. MISC. No.12056 of 2025(2) dt.25-02-2025 2/2 liable for the said offence. On the alleged settled land, petitioner's father have built their houses and they are residing in the said house. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas, in connection with Dehri (Town) P.S. Case No. 649 of 2017, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Prakash/- U
