1. The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-01-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in jail custody since 28-06-2014 in a case registered under Sections-302/34 of the Indian Penal Code. Admittedly, the petitioner is own daughter-in-law of the informant and the informant claimed that she committed the murder of deceased boy, who happened to be grandson of the informant. It is an admitted position that neither the informant nor any person claimed to have seen the actual killing of the deceased and the name of the petitioner has been dragged in this case on two grounds; firstly, some witnesses in course of investigation, claimed to have seen the petitioner, going along with the deceased prior to the alleged occurrence and secondly, the petitioner was seen by witnesses, washing her blood stained Sari.
Patna High Court Cr.Misc. No.581 of 2015 (3) dt.27-01-2015 Taking into consideration the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jamui P.
