JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 418, 419, 467, 120B of the Indian Penal Code.

The prosecution case is that the informant executed sale deed on 29.07.2010 to Bhirgu Nath Gond and Gauri Nath Gond with regard to the land of old Khata No. 3, Plot No. 2171/4923 and new Khata No. 948, Plot No. 3635, Area 9 decimal, but the petitioner got the sale deed executed with regard to the above land by setting up some imposter of the informant.

It is submitted by learned counsel for the petitioner that sale deed was executed in 2010 by the informant, whereas the present case was registered in 2014 when Title Suit No. 209 of 2011 was filed by the father of the petitioner against the informant.

No.1339 of 2016 (2) dt.11-01-2016 2/2 Considering the accusation arising out of civil nature of dispute, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar(T) P.S. Case No. 476 of 2014, arising out of Complaint Case No. 76 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
